Proposed law would prohibit texting while driving

California's trendsetting new cellphone driving law prohibits talking on the phone without a hands-free headset or other device. But the law is a little fuzzy when it comes to text messaging. Depending on the interpretation, it might be allowed.
California State Senator Joe Simitian, who represents the swanky Silicon Valley city of Palo Alto, has proposed legislation to close that loophole. It would charge drivers $20 for the first time they get caught texting behind the wheel. Fines for repeat offenses rise up to $50.
Regardless of whether the bill passes, the cops can always get you for reckless driving if they feel you are doing something unsafe, the California Highway Patrol says.
